In this case, the actions of the individual should not be prosecuted, not because of the circumstances surrounding her actions, but the circumstances that resulted in her discovery after the fact.

In my experience on social media and in person, folks that make broad attacks, blowing callumny at 30%+ of the population, have a distinct tendency towards fraud.

LR, what if a motorcycle cop followed a driver who flipped her off, and 2 miles down the road, saw the offending driver run a stop sign, and pulled him over?  Does free speech prevent cops from openly following (nothing that requires a warrant under 4a) someone that insults them?

You could probably contest this one and maybe, with a sympathetic judge, get out of it.  Police can harass people or experience road rage as well.  A badge doesn't make you immune to this behavior.  Having a cop follow you can make even exceptionally lawful drivers nervous.  You could argue the officer created a driving distraction and that was why you failed to see the stop sign. 

But at that point it's your word against theirs as far as how long they were following you and if they just happened to be going the same way or were stalking you.
