Europe moves a step closer to becoming Sharia compliant
« on: October 28, 2018, 10:09:58 AM »
"European Human Rights Court Rules Insulting Islam is a Crime" Their court declared that it is illegal to, and this is my words not theirs, tell the truth. They call it insulting Islam. A lady said that Mohammad married a six year old girl and consummated the marriage when she was nine and that type of behavior is akin to pedophilia.

I wonder if by this standard Charlie Hebdo was actually in violation of the law then when they printed their cartoons. In the gay marriage case our own Supreme Court pointed to changing international standards in their decision to legalize gay marriage so one has to wonder if this interpretation of the limits of free speech might be on its way here eventually especially with the standard of "yelling fire in a crowded theater" meaning that since saying these things often lead to death maybe limits are required for public safety.

Actually it appears it is upholding the right of countries to legislate to restrictions on religious related speech.

They similarly upheld laws that are contrary to Sharia law,

Quote
The ECHR has a history on ruling on sensitive issues related to Islam, often upholding measures that contradict Islamic practices. In 2014 and 20017, the court upheld French and Belgian bans of burqas and other Islamic garments that fully cover women’s faces. In 2017, it also endorsed a decision by Swiss authorities that Muslim schoolgirls had to take compulsory swimming classes.

and there have been stronger penalties for unflattering depiction of Jesus,

Quote
Austria is among several European countries that have so called blasphemy laws in their penal code. The Austrian caricaturist Gerhard Haderer was sentenced to six months in prison by a Greek court in 2005 for depicting Jesus as smoking marijuana and surfing over the Sea of Galilee.

So basically they are consistent in upholding countries ability to determine their own rules regarding issues surrounding religious speech and doesn't appear to have anything in particular favoring Sharia.

It is a real stretch to call this "a step closer to Sharia". LR outlines the case competently. I don't agree with it, but in no way does it favor Islam. If you want someone to blame, the blame lies more accurately with Austria.

I have identified as Christian ever since I was able to speak.  Never at any point would I have been offended by a depiction of Jesus smoking marijuana or surfing over the Sea of Galilee.  Jesus went walking on water at night during a storm so it's a no brainer that he'd have surfed if one was available.  And if he drank wine, smoking mj is no biggie.

“The domestic courts carefully balanced the applicant’s right to freedom of expression with the rights of others to have their religious feelings protected, and to have religious peace preserved in Austrian society,” stated the panel.

----------------------------

They seem to be putting a priority on preserving the peace. Insults against Mohammad have resulted in deadly violence. One can't help but wonder if the other issues such as the burka ban and swimming classes had similarly resulted in deadly terrorist attacks that specified them as the cause, if they would still be upheld. Or to turn it around one can't help but wonder if this decision would have come about without the deadly attacks caused by the Hebdo cartoons, the Van Gogh film, etc. Without the deadly violence if Islam, it wouldn't be necessary to curtail freedom of speech to preserve the peace. Violence and terrorism is rewarded with submission.

You can't ignore the context for the law in Austria, which was enthusiastic about the burning of Synagogues, deportation of Jews to Dachau, and general participation in genocide. Are they scared of terrorism, or trying to avoid that kind of outcome for Muslims?

I strongly disagree with the thread title that suggested that Europe ‘s crime against humanity is merely complying with Sharia.

In fact, the  sharia-promoting left care no more about Muslim freedom of religion than they cared about the well being of gay families during the SSM stuff.  Muslim feelings and the left wing pretense that Islam is a “race” are all about erasing freedom of speech from Western Civilization.  It’s all a move towards thought control and Muslims like gays and real trans persons are nothing more than human shields in the left wing war on free speech and the press.

Their rationale certainly opens the door to severe curtailments on the freedom of speech. What exactly is the standard here? What is the precedent it sets and how can it be applied to similar situations?

The headline says the court declared that insulting Islam is a crime.

So what about insulting Hinduism? Wouldn't it be an insult to Hindus to insist that all of their gods don't exist? And doesn't Islam do exactly that when it says that there is no god but Allah? It's also an insult to eat cows, a deadly insult now in some parts of India. They are really going down the rabbit hole here.

If Trump had any balls at all, you would list the EDU legislators Who passed the law against insulting Islam, and put them all on the no-fly list

Europe doesn't have the same standard of freedom of speech. They got burned by Hitler's freedom of speech outcomes, and so they are a little sensitive on the subject. It was only three months ago that historical video games were allowed to have swastikas on uniforms. They even had to digitally shave Hitler's mustache.

Now, that's a violation of the American Constitutional concept of free speech, but I can't really blame them.

I liv d in Europe, I know the history, and if you don’t “blame” Europe for Hitler, you’ve been taken. Europeans are smarter than Americans in a lot of ways, but when it comes to freedom of speech they are a special kind of stupid. Prelude speech is not what created the Nazis.
